1. Acceptance of Terms
These Terms and Conditions (“Terms”) govern your use of the services provided by Eko Recycling Pty Ltd (“Eko Recycling”, “we”, “us”, “our”) and your use of our website at www.ekorecycles.com.au.
By using our services, visiting our website, or selling scrap metal to us, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
We reserve the right to update these Terms at any time.
Changes will be posted on our website with an updated “Last Updated” date. Your continued use of our services after any changes constitutes acceptance of the updated Terms.
2. Our Services
- Mobile Collection: We collect scrap metal from your location (subject to minimum quantities and service area)
- Drop-Off Service: You deliver scrap metal to our yard at 17 Hilton St, Dandenong VIC 3175
- Bin Hire: We supply bins for ongoing scrap metal collection
3. Identification Requirements
3.1 Acceptable Identification
You must provide one of the following photo identification documents:
- Australian driver’s licence
- Australian passport
- Foreign passport
- Australian firearms licence
- Proof of age card
Alternatively, you may provide two non-photo identity documents such as:
- Birth certificate plus Medicare card
- Citizenship certificate plus bank statement
We cannot process any transaction without valid identification. This is a legal requirement, not a policy choice.

4. Payment Terms
4.1 No Cash Payments
IMPORTANT: Under the Second-Hand Dealers and Pawnbrokers Act 1989 (Vic), cash payments for scrap metal are prohibited. We cannot make cash payments under any circumstances.
4.2 Accepted Payment Methods
Payment will be made by:
- Electronic Funds Transfer (EFT): Direct deposit to your nominated Australian bank account
- Bank Cheque: Non-transferable cheque made payable to you (not payable to “cash”)
You must provide valid bank account details (BSB, account number, account name) for EFT payments. We are not responsible for payments made to incorrect bank details that you have provided.

Quotes provided via our website, phone, email, or in person are estimates only and do not constitute binding offers. The final price will be determined at the time of transaction based on:
- Current market prices at time of weighing
- Actual weight of materials as measured on our calibrated scales
- Grade and quality of materials
- Level of contamination or mixed materials

6. Accepted Materials
6.1 Materials We Buy
We purchase a range of ferrous and non-ferrous metals including:
- Copper (all grades: bright copper, #1 copper, #2 copper, copper wire, copper pipe, copper radiators)
- Aluminium (cans, extrusions, cast, sheet, wire)
- Brass (yellow brass, red brass, brass fittings)
- Steel (structural steel, sheet steel, stainless steel)
- Lead (lead pipe, lead flashing, wheel weights)
- Cables and wire (insulated and stripped)
- Batteries (car batteries, truck batteries, industrial batteries)
6.2 Prohibited Materials
- Radioactive materials
- Asbestos or asbestos-containing materials
- Sealed gas cylinders or pressurised containers
- Ammunition, explosives, or weapons
- Medical or clinical waste
- Mercury, PCBs, or hazardous chemicals
- Refrigerators or air conditioning units with refrigerants not properly evacuated by a licensed technician
- Motor vehicles containing fuel, oil, or other fluids
- Whitegoods (washing machines, dryers, dishwashers, microwaves)
- E-waste (computers, TVs, electronic equipment)
- Materials suspected of being stolen
7. Customer Warranties
By selling scrap metal to us, you warrant and represent that:
- You are the legal owner of the materials or are authorised to sell them
- The materials are not stolen, subject to any security interest, or otherwise encumbered
- The materials do not contain hazardous substances not disclosed to us
- All fluids, refrigerants, and hazardous substances have been properly removed and disposed of in accordance with environmental regulations
- All pressurised containers have been safely evacuated
- The information you provide, including identification details, is true and correct
- You are over 18 years of age
8. Mobile Collection Service
8.1 Service Area
8.2 Minimum Quantities
Free pickup is available for qualifying loads. Minimum quantity requirements vary by metal type and location. Please contact us for specific minimum requirements for your area.
8.3 Site Access
By booking a mobile collection, you grant us a licence to enter your premises at the agreed time. You warrant that:
- You have authority to grant us access to the property
- The site is safe for vehicle access and loading operations
- Materials are accessible and ready for collection
- There is adequate clearance for our vehicles (minimum 3.5m height, 3m width)
You must inform us of any height limits, weight restrictions, overhead obstructions, or special access requirements when booking. A futile trip fee may apply if we are unable to complete the collection due to access issues, materials not being ready, or materials differing significantly from what was described.
9. Bin Hire Service
9.1 Bin Ownership
All bins supplied by Eko Recycling remain our property at all times. You are responsible for the bin from the time of delivery until collection.
9.2 Your Responsibilities
During the hire period, you must:
- Use the bin only for permitted scrap metal materials
- Not overload the bin beyond the fill line
- Prevent third-party or unauthorised use
- Prevent damage, theft, or vandalism
- Position the bin on a firm, level surface
- Obtain any necessary council permits for placement on public property
9.3 Additional Charges
Additional charges may apply for:
- Contaminated loads containing prohibited materials
- Damage to bins beyond normal wear and tear
- Excessive wait times during delivery or collection
- Relocation of bins
- Extended hire periods
10. Limitation of Liability
10.1 Consumer Guarantees
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a remedy if services fail to meet these guarantees. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Competition and Consumer Act 2010 (Cth) or any other applicable law that cannot be excluded, restricted, or modified.
10.2 Liability Cap
Subject to clause 10.1, to the maximum extent permitted by law, Eko Recycling’s total aggregate liability arising out of or in connection with any transaction or these Terms (whether in contract, tort including negligence, under statute, or otherwise) is limited to the total amount paid or payable for that specific transaction.
10.3 Exclusion of Consequential Loss
Subject to clause 10.1, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, business, goodwill, or anticipated savings.
11. Indemnity
You agree to indemnify and hold harmless Eko Recycling, its directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including legal fees) arising out of or in connection with:
- Your breach of these Terms
- Your breach of any warranty in clause 7
- Any contaminated, hazardous, or prohibited materials delivered by you
- Any claim by a third party that materials sold to us were stolen or that you did not have authority to sell them
- Any breach of environmental laws or regulations relating to materials you provide
- Any personal injury or property damage caused by materials you deliver
12. Website Use
12.1 Permitted Use
You may use our website for lawful purposes only. You must not use our website in any way that breaches any applicable laws or regulations, is fraudulent or harmful, or involves the transmission of malware or other harmful code.
12.2 Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of Eko Recycling or our licensors and is protected by Australian and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.
12.3 Website Availability
We do not guarantee that our website will be available at all times or that it will be free from errors or viruses. We may suspend, withdraw, or restrict access to our website at any time without notice.
13. Dispute Resolution
If a dispute arises in connection with these Terms or our services:
- Notification: The party claiming a dispute must give written notice to the other party, setting out the nature of the dispute.
- Negotiation: Within 10 business days of notice, representatives of each party shall meet and attempt to resolve the dispute through negotiation in good faith.
- Mediation: If the dispute is not resolved within 20 business days, the parties agree to attempt to resolve the dispute through mediation administered by the Dispute Settlement Centre of Victoria before commencing any court proceedings. Mediation costs will be shared equally.
- Court Proceedings: Nothing in this clause prevents a party from seeking urgent interlocutory relief from a court.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of Victoria, Australia. You agree to submit to the exclusive jurisdiction of the courts of Victoria and any courts that may hear appeals from those courts.
15. General Provisions
15.1 Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed from these Terms and the remaining provisions will continue in full force and effect.
15.2 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it at a later time.
15.3 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Eko Recycling regarding the subject matter herein and supersede all prior or contemporaneous communications and proposals.
15.4 Assignment
You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms to any third party.
16. Privacy
